Purposes of processing and legal bases

Own commercial and marketing purposes related to the services offered by the Company.

  • Legal basis: legitimate interest.

This includes market analysis and statistics, profiling, personalisation of commercial actions, data segmentation, and the sending of commercial information, offers, discounts and promotions related to our services through electronic channels linked to smart devices (email, SMS, instant messaging apps, MMS) and non-electronic channels (including postal mail).

Newsletters and bulletins about TRIPWOOW S.L products and services.

With the user’s consent, we collect and process personal data in order to send information about our products and services. We will retain those data until the user withdraws consent and for the period required by law.

The legal basis for this processing is the consent granted by the user when ticking the box accepting our Privacy Policy before subscribing to the newsletter through the form enabled for that purpose on the website. The user may withdraw consent at any time without affecting the lawfulness of processing carried out before withdrawal.

You may stop receiving commercial communications from the Company at any time and at no cost. To do so, you may: (i) click the unsubscribe links included in all emails related to Tripwoow; (ii) send an email to hola@tripwoow.com; or (iii) manage your preferences through your profile, where available.

For this purpose, data may be made available to third-party service providers located within the European Union acting as data processors.

How is your data processed?

Your personal data are collected through tripwoow.com (the “website”) during the registration process and in the course of providing the services offered on it (the “services”). This Privacy Policy forms an integral part of the terms and conditions published on the website.

If, for any reason, you decide not to provide us expressly, freely and voluntarily with the data necessary for the provision of the services, and where your express consent is required, you will not be able to benefit from the services or any aspects connected with them.

If you provide us with your data, you guarantee that they are truthful and accurate. You must also keep them complete and up to date, and you undertake to be liable for any direct or indirect damage that may result from failure to comply with that obligation.

If you provide us with personal data relating to third parties, you guarantee that you have informed them of the content of this Privacy Policy and that you obtained their prior express consent before providing those data.

In other words, you may not provide us with personal data relating to third parties unless you are duly authorised by them. If you do so, you expressly assume any liability arising from that conduct.

We also inform you about the possible processing of data when users interact with the Company’s profiles or pages on social networks, for the purposes permitted on each platform, including analytics. If the Company runs specific offers or promotional actions through social networks, those actions will be governed in accordance with the rules applicable to each platform.

What specific examples of personal data processing carried out by the Company may affect me as a customer?

You book activities and/or excursions with us by providing your name, surname, mobile phone number or email address, as well as those of your companions where necessary. However, the underlying contract is entered into with third-party service providers, and Tripwoow acts solely as an intermediary. Our role is limited to facilitating management on behalf of third parties so that you can enjoy a wide range of tourism-related options.

At present, we do not manage or process specially sensitive data for hidden purposes. If photographs or videos in which you appear form part of the services or of services provided by third parties, your express consent must be obtained before they are used on our website or on our social media channels.

We may also carry out market research and personalised surveys to improve the Company’s services and its position within the tourism sector.

How long do we keep your data?

We will process the personal data you provide for the purposes described above while: (i) the legal relationship remains in force; (ii) for the years necessary to comply with legal obligations; and, regarding the remaining purposes mentioned, until you request erasure.

Are your data shared with third parties?

Yes, where necessary to carry out the purposes described above. Your data may be disclosed to third parties in the following categories:

Service providers: we share the personal data needed to complete, personalise or amend your booking. This includes the data provided during the booking process.

Technology service providers.

Suppliers and collaborators related to advertising and marketing services.

Public authorities, in order to comply with legal obligations.

The Spanish Tax Agency and other public authorities for compliance with tax obligations.

Competent public authorities in the field of tourism.

Other public bodies or related entities where required by law.

Other third parties, such as:

Credit institutions or payment institutions, including POS systems and payment gateways, for the management of collections and payments.

Postal and notification companies for the communication of information.

External service providers for invoice management and archiving, accounting documentation or legal services.

Your personal data will only be transferred to third parties acting as processors and only where they process the data on behalf of the Company in accordance with instructions issued by TRIPWOOW.

WE DO NOT STORE OR HAVE ACCESS TO YOUR PAYMENT CARD DETAILS AT ANY TIME.

As a general rule, your personal data are processed within the European Union.

Google Analytics may collect the following categories of data:

Online identifiers, including cookie identifiers.

Internet Protocol addresses and device identifiers.

Customer identifiers.

We will also share your personal data where required by applicable law.

What happens if this Privacy Policy changes?

We will inform you whenever we propose changes. You should be aware at all times of any potential amendments introduced by TRIPWOOW in this area.

In any case, the level of protection applied by the Company to protect and process your personal data will continue, at a minimum, to respect the standards currently implemented, regardless of any amendments that may be introduced.

If any change takes place, we will notify you through the website and by email so that you remain informed of all updates. The impact of the proposed amendment will determine whether your express consent is required in order for you to continue using the services as a customer.

What rights do you have?

TRIPWOOW guarantees the confidentiality of your data through the use of techniques and processes adapted to the current state of technology.

You may contact us at any time to exercise any rights granted to you under applicable law.

To do so, send an email to hola@tripwoow.com indicating the reason for your request in the subject line and the right or rights you wish to exercise. If necessary, we may ask you for a copy of a document proving your identity.

You may withdraw your express consent for the processing of your personal data at any time and at no cost. However, please note that if you withdraw consent, you may not be able to enjoy the services or complete your Tripwoow experience fully.

You may always:

Access the data we hold about you.

Request the rectification of any data we already hold. By providing your data, you guarantee that: (i) you are over eighteen years of age; (ii) you undertake to notify us of any change or update if necessary; and (iii) the data provided are true, accurate and complete, and you are responsible for any direct or indirect damage that may result from failure to comply with this obligation. As a general rule, you should provide only your own personal data. If the data provided belong to a third party, you guarantee that you have informed that third party of the matters contained in this document and obtained their authorisation to provide us with their data for the purposes indicated.

Request erasure of your data whenever they are no longer necessary for the purpose for which they were collected, or where we no longer have a legal basis for processing them.

Request restriction of the processing of your data, which may result in a temporary suspension of such processing and of the service or services to which they relate.

Withdraw your consent at any time, as explained above.

Request the portability of your personal data. In that case, you will receive them in a structured, commonly used and machine-readable format so that you can provide them to another entity, where technically possible.
